Chapter I General Provisions

Article 1 In order to strengthen fire protection work, implement fire safety responsibilities, prevent and resolve fire safety risks, prevent and reduce fire hazards, and ensure the safety of people's lives and property, in accordance with the Fire Protection Law of the People's Republic of China and the Implementation of the Fire Protection Law of the People's Republic of China in Guangdong Province These regulations are formulated in accordance with the actual conditions of the province and other laws and regulations and relevant national regulations.

Article 2 These Provisions shall apply to the fire control work within the administrative region of this Province.

Where laws and regulations provide otherwise for fire control work, such provisions shall prevail.

Article 3 The people's governments at various levels shall be responsible for the fire control work within their respective administrative areas.

The emergency management department of the people's government at or above the county level shall guide and coordinate the fire protection work within its administrative area in accordance with the law; the fire rescue agency shall perform the comprehensive fire safety supervision function in accordance with the law, and shall undertake the comprehensive urban and rural fire rescue, fire prevention, fire supervision and law enforcement, and fire accident investigation and handling related work in accordance with the law; The competent department of housing and urban construction shall perform the functions of fire protection design review, acceptance, do a good job of fire protection in relevant industries and fields in accordance with the law.

The fire control work in functional areas such as pilot free trade zones, development zones and industrial parks shall be carried out in accordance with relevant laws, regulations and rules, as well as relevant national and provincial regulations.

Article 4 Fire safety committees at all levels shall, in accordance with regulations, coordinate and solve major problems in fire protection work in their respective regions, urge member units to implement the fire safety management responsibilities of their own systems and industries, and organize and carry out special fire safety management and fire protection work assessment.

Article 5 Relevant industry organizations shall, in accordance with the characteristics of the industry, strengthen fire protection publicity and education and fire safety self-discipline management, and promote member units to perform the main responsibility for fire safety.

Article 6 Encourage units and individuals to make donations to public fire protection undertakings. The donated funds and materials are used for the construction and maintenance of public fire-fighting facilities, fire-fighting vehicles and equipment, fire-fighting public welfare activities, and condolences to the survivors of the injured, disabled and sacrificed in fire rescue in accordance with regulations.

Encourage and support social forces to carry out fire prevention, fire public welfare publicity, fire safety assistance and other fire volunteer services.

Article 7 People's governments at or above the county level and their relevant departments shall use advanced technologies such as big data, the Internet of Things, and cloud computing, adopt government investment, entrusted operations, etc., to promote the construction of a fire protection big data application platform for co-construction and sharing, and carry out Full-time and visual fire safety monitoring, evaluation and early warning.

Encourage relevant departments and units to make full use of fire big data results in industry management, credit supervision, and insurance services.

Chapter II Fire Safety Responsibilities

Article 8 People's governments at all levels shall fully perform their duties in fire control work.

All regions shall, in accordance with the actual conditions of the region, strengthen the construction of public welfare fire protection publicity, education and training places such as fire science popularization bases, fire protection experience halls and fire protection theme parks.

Article 9 Township people's governments and sub-district offices shall perform their fire control duties in accordance with laws, regulations and rules and the relevant provisions of the State, and strengthen the following fire control work:

(I) clarify the specific institutions and personnel responsible for fire protection work, implement the "grid" management measures for fire safety within their jurisdiction, and improve the fire protection training, performance incentives, and supervision and accountability mechanisms for grid personnel;

(II) strengthen the fire safety inspection of old buildings, small places, "three-in-one" places, public entertainment places, farmhouses (homestays), electric bicycles and electric motorcycles parking and charging places in the jurisdiction, and urge the rectification of fire hazards;

(III) strengthen the safety management of fire and electricity use in village-level industrial parks and other rural production and operation sites, and implement fire prevention measures and responsibilities;

(IV) and coordinate the handling of residential property fire safety management issues, strengthen the fire safety inspection of rental housing within the jurisdiction;

(5) In accordance with the principles of adjacent locations and similar industries, organize units within their jurisdiction to carry out fire safety regional joint defense work.

Article 10 Villagers' committees and residents' committees shall perform fire safety responsibilities in accordance with the law, assist people's governments at all levels and relevant departments to do a good job in fire safety "grid" management, fire hazard investigation and remediation, emergency evacuation drills, etc., and urge guardians or others Responsible persons strengthen the safety supervision of the use of fire and electricity by orphans, left-behind children, elderly people living alone, severely disabled persons, mentally disabled persons and mentally disabled persons.

Article 11 organs, organizations, enterprises, institutions and other units shall implement the main responsibility for fire safety in accordance with laws, regulations and rules and relevant provisions of the state; regularly assess and evaluate the ability of fire safety managers of their own units to perform their duties, and publicize the fire safety conditions of fire safety responsible persons, managers and places, and accept social supervision.

The fire safety managers of key fire safety units shall take up their posts with certificates according to law. Fire high-risk units shall participate in fire public liability insurance in accordance with national regulations, and hire registered fire protection engineers to participate in fire protection work according to actual needs.

Encourage agencies, organizations, enterprises, institutions and other units to hire fire safety training institutions to participate in the fire safety knowledge training for their employees.

Article 12 the transportation, postal administration, grain reserve and other relevant departments shall, within the scope of their respective duties, supervise and guide the operators, owners or managers of relevant logistics, delivery and storage places to implement the main responsibility of fire safety and the relevant fire control work system.

Article 13 Rail transit operation units shall establish and improve the fire safety system and fire safety operation procedures, strengthen the knowledge and skills training of fire rescue and personnel evacuation, equip professional fire fighting and rescue equipment suitable for the fire safety of rail transit in accordance with the regulations, implement unified management and unified deployment and use; build fire fighting pools or water intake terminals in areas close to rail stations and tunnel entrances and lack of water sources to meet the needs of fire fighting and rescue water; according to the needs, various forms of fire fighting organizations such as rail full-time fire brigades shall be set up, or professional forces shall be entrusted to be responsible for the fire rescue work of rail transit by purchasing services.

The administrative organization of highway tunnels shall, with reference to the provisions of the preceding paragraph, implement the fire safety responsibilities of highway tunnels.

Article 14 Where a building or place is leased for use, it shall meet the fire safety conditions. The Lessor and the Lessee shall clearly define in writing and perform their respective fire safety responsibilities; if not clearly defined in writing, the Lessor shall be responsible for the unified management of the public evacuation routes, safety exits, building fire protection facilities and fire truck routes, and the Lessee shall be responsible for the fire safety of the leased building or premises.

For rental housing, the original designed room shall be the minimum rental unit, and the per capita rental building area shall not be lower than the minimum standard set by the local people's government.

If the lessor discovers that the lessee has any of the following circumstances, it shall urge the lessee to make rectification in a timely manner:

(I) the lessee to change the use function or structure of the leased building or premises without authorization, which affects the fire safety;

(II) the Lessee's illegal parking or charging of electric bicycles or motorcycles in the leased building or premises;

(III) the lessee has other acts affecting fire safety in the leased building or premises.
